1. Acceptance of Terms

By accessing or using Creative Hub ("the Service"), operated by Second Oak, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

Creative Hub is a creative content management platform that enables users to:

Generate AI-powered creative content using Google Gemini.
Manage brand assets, projects, and creative workflows.
Create and launch advertising campaigns on Meta (Facebook/Instagram) and Google Ads.
Track ad performance and attribute revenue from connected e-commerce platforms.

3. Account Registration

You must create an account to use the Service. You are responsible for:

Providing accurate and complete registration information.
Maintaining the security of your account credentials.
All activities that occur under your account.

You must be at least 16 years of age to create an account.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations.
Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
Infringe upon the intellectual property rights of others.
Create misleading or deceptive advertising content.
Attempt to gain unauthorized access to the Service or its related systems.
Interfere with or disrupt the integrity or performance of the Service.

5. AI-Generated Content

Creative Hub uses AI (Google Gemini) to generate images and text. You acknowledge that:

AI-generated content may not always be accurate, appropriate, or suitable for your intended use.
You are solely responsible for reviewing and approving all AI-generated content before use.
You are responsible for ensuring AI-generated content complies with applicable advertising standards and platform policies.
Second Oak does not claim ownership of AI-generated content created through your use of the Service.

6. Third-Party Integrations

The Service integrates with third-party platforms including Meta, Google Ads, and Shopify. By connecting these services, you:

Authorize Creative Hub to access and manage your accounts on those platforms.
Agree to comply with the terms of service of each connected platform.
Acknowledge that Creative Hub is not responsible for actions taken by third-party platforms.
Understand that advertising spend and transactions on connected platforms are your responsibility.

7. Advertising and Financial Responsibility

When using Creative Hub to create and launch advertising campaigns:

You are solely responsible for all advertising costs incurred on connected platforms.
You are responsible for ensuring your ads comply with all applicable advertising laws and platform policies.
Second Oak is not liable for any advertising spend, rejected ads, or account suspensions on third-party platforms.

8. Intellectual Property

You retain ownership of all content you upload to Creative Hub, including brand assets, images, and text. You grant Second Oak a limited license to store and process this content solely for the purpose of providing the Service.

The Creative Hub platform, including its design, code, and branding, is the intellectual property of Second Oak.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Service Availability

We strive to keep Creative Hub available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service interruptions.

11. Limitation of Liability

To the maximum extent permitted by law, Second Oak shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, but is not limited to, loss of profits, data, or business opportunities.

Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms. You may also delete your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. Changes will be reflected by updating the "Last updated" date at the top. Continued use of the Service after changes constitutes acceptance of the updated terms.

14. Governing Law

These Terms are governed by the laws of Sweden. Any disputes shall be resolved in the courts of Sweden.
